Patriot Legacy Shield™ — Membership Terms (Texas)

Effective date: [Month Day, Year] • These terms (the "Agreement") govern the Patriot Legacy Shield™ preventative roof maintenance program ("Program") delivered by Patriot Roofing Texas, LLC ("Patriot").

1) Program Overview & Qualification

The Patriot Legacy Shield™ is an exclusive, service-based preventative maintenance program. It provides services including scheduled inspections, routine maintenance, and priority scheduling for members.

1.1) Prerequisite: Qualification Inspection

Access to the Program at any tier, including the free Bronze tier, is exclusive and contingent upon the property's roof passing an initial **Qualification Inspection** conducted by Patriot. This inspection is performed at no cost to the homeowner to determine if the roof is in a serviceable condition suitable for preventative maintenance.

• Patriot reserves the right, in its sole discretion, to deny membership to any property based on the findings of this inspection (e.g., severe pre-existing damage, improper installation, obsolete materials).
• If serviceable repairs are required to meet qualification standards, membership shall be denied until such time as the repairs are completed by Patriot (or another mutually agreed-upon contractor) at the homeowner's expense. See §3.

3) Exclusions & Limitations

Services under this Agreement expressly exclude the following:

• Pre-Existing Conditions: Any issues, defects, or damage identified during the initial Qualification Inspection (§1.1) are defined as "Pre-Existing Conditions." Such conditions are explicitly excluded from all Program services. Membership shall not be granted until such conditions are rectified to Patriot's standards at the homeowner's expense.
• Major Repairs: Full leak diagnostics/repairs outside routine reseals; decking/structural repairs; interior repairs; gutter cleaning; ventilation/insulation upgrades; emergency tarping; replacement of materials beyond the minor scope defined in the Gold tier.
• External Causes: Hidden conditions, manufacturer defects, animal/insect activity, and acts of God are outside the program unless separately quoted and approved.
• Access: Work requiring specialty access/equipment (e.g., high-lifts for >2 story roofs) may incur additional costs when authorized by the homeowner.

4) Carry-Forward Value (Silver & Gold)

Carry-Forward Value applies only to active, paid Silver and Gold memberships. If annual maintenance needs are minimal, a portion of the paid membership fee may accrue as carry-forward value.

• The value amount, if any, is determined by Patriot based on services performed and recorded in the Member Portal.
• May be applied only to future roofing services performed by Patriot on the enrolled property.
• Has no cash value, is non-transferable, and expires immediately if the membership lapses or is canceled.

5) Scheduling, Access & Safety

• Patriot will contact the Member to schedule the initial Qualification Inspection, and subsequently, to schedule the annual service window. Dates are subject to weather and safety conditions.
• Member agrees to provide safe access to the roof and attic (where applicable). All pets must be secured and gates unlocked.
• Missed appointments may incur a reasonable trip fee.

6) Documentation & Claims

Member receives digital reports to assist with manufacturer maintenance expectations and insurance communications. Patriot does not control third-party warranty or claim decisions, nor does Program participation assure claim approval.

7) Priority Storm Response (Silver & Gold)

After declared severe weather, active paid Silver and Gold members are scheduled for damage assessments ahead of non-members and Bronze members. Response times depend on event scale and safety. Temporary measures (e.g., dry-in) may be quoted if beyond routine scope.

8) Term, Renewal & Cancellation

• Qualification & Onboarding: If a property fails the initial Qualification Inspection (§1.1), membership is denied. If the homeowner elects not to perform the required repairs, this Agreement is void.
• Term & Renewal: The term for paid Silver/Gold memberships is twelve (12) months and renews automatically. The term for the free Bronze membership is continuous, renewing annually.
• Cancellation: Member may cancel at any time. If a paid membership is canceled *after* the annual service is performed, fees for that term are non-refundable. If canceled *before* service, a pro-rata refund may be considered.
• All benefits, including Carry-Forward Value, are forfeited upon lapse or cancellation.

9) Pricing & Changes

Membership fees for Silver and Gold tiers may vary. Pricing may change at renewal with notice. Patriot may update these terms; current terms will be posted on this page with an effective date. Continued membership constitutes acceptance of any changes.

10) Community Contribution

Patriot allocates a portion of paid memberships to community roofing initiatives. This contribution is made by Patriot and is not tax-deductible for the Member.

11) Limits of Liability & Disclaimer

Member acknowledges and agrees that this Program is a preventative service plan and not a warranty or insurance policy as defined in §1.2.

• Except where prohibited by law, Patriot’s total liability related to the Program is limited to the membership fee paid for the current term.
• Patriot shall not be liable for any incidental, consequential, special, or punitive damages.
• Nothing herein overrides manufacturer instructions or applicable building codes.

12) Governing Law

This Agreement shall be governed by the laws of the State of Texas. Venue and jurisdiction lie in Tarrant County, Texas.
